border-box;'>郑某某所涉案情为：2017年8月至被捕期间，伙同他人租房、聘请人员，利用“超级大富豪”“金利”“宽窄”“天府”“夜游神”等游戏软件，采用购买游戏币的方式，进行网络赌博，非法获利283万余元。向其母亲王某某银行卡转账123万余元。侦查机关依法冻结其母亲银行卡上全部现金100万元。</p><p style='box-sizing: border-box;'>因为郑某某平时比较节俭，工作又特别努力，同时在帮别人做传奇代练，卖传奇、倩女幽魂、稻草人游戏装备，介绍美容，投资房地产，合伙开烧烤，酒吧卖酒等等，获利颇多。在被捕时，其自有银行卡上有资金91万元，也被冻结。在为郑某某辩护期间，郑某某对自己开设赌场的行为供认不讳，但对开设赌场获利283万余元，一直不服。</p><p style='box-sizing: border-box;'>鉴于利用网络开设赌场案件的情节和量刑，非常复杂和麻烦，涉及赌场开设时间周期长短，同案分工情形，参赌人员多少，涉赌金额大小，获利数额及分配，社会影响，特别是网络数据和情节的认定等等，非常纷繁，难以梳理。虽然在审查起诉期间，做了认罪认罚，并签署了《认罪认罚具结书》，但针对获利金额，辩护人与公诉人也无法达成一致意见，双方言明：起诉到人民法院，由合议庭裁决。</p><p
